Hi All,
My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.
My questions are:
Will they re-consider my case if lawyer submits the correct EIN number?
How much time will it take to process, if the willing to re-consider the case?

The memoirs of Sen. Edward M. Kennedy, the youngest and last surviving brother of the country's most famous political siblings and for decades an eminent liberal statesman and legislator, have been acquired by an imprint of the Hachette Book Group USA.
Financial terms were not disclosed, but a publishing official with knowledge of the negotiations said Monday that the agreement was comparable to the $8 million Sen. Hillary Rodham Clinton received for "Living History" and the $9 million former British Prime Minister Tony Blair will reportedly get for his planned memoir. The official spoke on the condition of anonymity, following standard industry practice.
"I've been fortunate in my life to grow up in an extraordinary family and to have a front row seat at many key events in our nation's history," Kennedy, 75, said in a statement. "I hope my reflections can contribute to a deeper understanding of many events in the history of this great country and to a more in-depth picture of an American family."
Hachette's acquisition came after a six-day auction involving nine publishers. Kennedy was represented by Washington attorney Robert Barnett, whose other clients include Clinton and Tony Blair.
The book, currently untitled and tentatively scheduled to come out in 2010, builds upon the oral history project that Kennedy has been working on through the Miller Center of the University of Virginia. The project, launched in 2004 and expected to last several years, will include interviews with the senator, family members, colleagues, journalists, foreign leaders and others.
For his memoir, Kennedy plans to use a co-author/researcher, still to be determined. A "significant" portion of the proceeds will be donated to charity, including the John F. Kennedy Library, where the senator's public and private papers will eventually be stored, according to Kennedy adviser Stephanie Cutter.
The book will be published by the Hachette imprint Twelve, founded two years ago by former Random House editor Jonathan Karp
"The senator's book is not about the money," Karp told The Associated Press. "I think it's about telling a story that only he can tell. He's both seen history and he's made history. His perspective is unique, and it would be a tremendous loss if he did not put his experiences in writing."
Karp said that he and other Hachette officials went down to Washington last fall to meet with the senator at his home, where they talked in Kennedy's study, family pictures on the walls, books by Robert Caro and David McCullough on the shelves.
"He intends to be candid," Karp said. "He's a great raconteur and he talked so articulately and disarmingly about his childhood and some of his political experiences over the years that you got the sense that this is a man capable of captivating anyone with a story."
Kennedy, a Massachusetts Democrat and the youngest of nine children, was first elected to the Senate in 1962, when he was voted in to fill the seat initially vacated by his older brother, John F. Kennedy, who had been elected president. Ted Kennedy was just 30 at the time, barely old enough to legally have the job, and his greatest burden was living down the taunt of his Democratic primary opponent, Edward J. McCormack: "If your name was simply Edward Moore instead of Edward Moore Kennedy, your candidacy would be a joke."
Kennedy's achievements and troubles exceeded everyone's expectations. Brothers John F. Kennedy and Robert F. Kennedy were assassinated, and personal scandal � most notably a 1969 accident in which a car he drove ran off a bridge, killing passenger Mary Jo Kopechne � helped prevent Ted Kennedy from becoming president himself.
But he also emerged as one of the Senate's most accomplished and eloquent legislators, respected even by Republicans for his knowledge and hard work, and for his role in passing bills on education, wages, health care, immigration and many other issues. Last year, he was easily elected to his eighth full term and has no plans to retire, according to Cutter.
Kennedy's previous books include "My Senator and Me," a children's story, and "America Back on Track." He has been the subject of countless works and cooperated with one author, Adam Clymer, for a biography that came out in 1999.

My husband got into the country through the Mariel port
immigration from Cuba in 1980 hes been in this country since then. Im a
US citizen we are legally married. The problem was that 20 years ago
when he was about to get is residency he got incarcerated and the
process was can canceled by the immigration office. About 4 or 5 years
ago he lost all of his papers he has no ID or any document that proves
his legal status. Which I think is not going to be any help anyways
because he never got a Visa number he did got a an alien number but of course he doesnt remember it so basically he is in paper limbo, because you need an ID to get an ID. He recently got his Cuban passport but now we find out that is basically useless. I been trying to get someone to please explain to me in this case what can we do? It seems that because he is Cuban and enter the country as a refugee almost 30 years ago no one can tell me for sure what will be the procedure in his case.
Please if there anybody that can help I would really appreciated

I had breakfast today with a few advocates and an Obama Administration official who noted that the immigration summit will now be held on June 25th. Encouraging. I also learned that the current expectation is that the immigration reform bill will likely start in the Senate and that Senator Reid is hoping for reform legislation to be considered in the fall.

I am working with a consulting company and my company filed for my GC in 2009 (PD is 25-Feb-2009). I received my I-140 approval on 28-Feb-2010. Now the client where I am working, has offered my a fulltime job and GC processing. I have received mutual consent from my current company for any legal issues. Now, if I join the new company and file my GC from there, can I port my Priority date for the new processing? Also, what should be the earliest joining date? What all other precautions should I take while filing GC with the new company?
I received the offer on 07/09 and have to give my decision by 07/15. I would appreciate if anyone can help.

Dear forum members,
I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.
Question is
1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?
2) When can i start working for the new company?
Any response will be appreciated.

If your 140 is approved the chances of 485 denial are quite remote. however most attorneys recommend that you try to stay on H1 as much as possible

I have filed my 485 on July 2007. I am currently working using EAD and last time entered US in Feb 09 using AP. My current AP is valid till Oct 17 2009. I will be going out of the country for few days in early Sep. I wanted to know can I apply for my renewal of AP now. I read the following in the I-131 filing instructions (page-4)
If you travel before the advanced parole document is issued, your application will be deemed abandoned if:
1. You depart the United States; or
2. The person seeking advance parole attempts to enter the United States before a decision is made on the application
So can I apply for my AP renewal now (I am assuming if I apply now it won't get approved before my travel in Sep) or do I need to first complete my travel in Sep, come back to US and then apply for the renewal.
Please reply.

Can some1 help me to sort out my problem:
- I was working for a company A in L1-B which was about to expire by Dec 2006. So I applied for H1 and got the petition / application approved. I received the I94 also.
- But due to some reason, I travelled back to India and didn't submit the H1-I94 @ the port of exit.
- Now the same company A again processed me L1 in India and Im back to US after a yr. with the new L1 and never told any1 about my existing H1B visa
I need to know whether can I start looking jobs on that H1B without legal procedures?
Is there anything i have to do in order to activate my H1??

Can we apply for I - 485 without having the I -140 receipt notice.What is the work around so that I dont miss the Aug 17,2007 date for filing I -485.Are there any chances that my I - 45 will be rejected, or will I ge an RFE.

Your PD must be current and 485 filing date (which is also called RD - received date) should be close to USCIS processing times. Currently, I believe that USCIS is working on applications that it received in July 2007.
But it is USCIS :D - miracles happen!!! Last year, they approved 2006 PD cases while applicants with 2003/2004/2005 were waiting :D Good luck.

I am on H1 right now. I got my H1 last year, Before that I was on OPT (F1). I didnt go to India after I got my H1 and I am employed since the H1 started (Oct 1,2007). I am planning to go to India now in dec. I heard that if you stay more than an year after getting H1 and without getting the passport stamped, I need to fill out an additional form before I got to the visa interview. Is this true??
Secondly, When I applied for H1, I applied thru company A. But even before the H1 started (which is Oct 1,2007) and as soon as my H1 (for company A) got approved (Sept 10, 2007) I applied for H1 transfer to company B. So I was on Company B's H1 from Oct 1,2007 (which is the actual start date of my H1). Now, would this pose a potential problem at the visa interview?

If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.
Has anybody done this successfully. Can you point to some clarification or law from USCIS itself?

if you already have a prospective employer who will sponsor you, just fill out everything and have your lawyer ship the application april 1st.
