Immigration Lawyers Blog Has Just Posted the Following:
On April 15, 2010, the Department of Homeland Security issued the USCIS �Annual Report on Characteristics of Specialty Occupation Workers (H-1B) for Fiscal Year 2009.� The summary reports on information including the countries of origin, occupations, education levels, and compensation paid to those who had approved H-1B petitions in FY 2009. The report includes the following facts: approximately 48 percent of all H-1B approved workers were born in India; 41 percent were for workers in computer-related occupations; and 41 percent were for workers with a bachelor�s degree and 40 percent had a master�s degree. Guys,
I am on L1 .My wife is working for a Indian s/w MNC and was earlier in L1.Once her project got over they sent her to India.She applied for vacation and came here on L2.During visa stamping the officer cancelled her L1 visa in passport.We applied for her EAD in July and are expecting to receive it in a few days.This is the first scenerio.
Secondly, we applied for 485/140/AP/EAD in the second week of Aug 07.No updates yet with regards to cheques/receipt notices etc.
We tried to contact her company's office here to look out for employment based on L2 EAD.But they mentioned that they wanted her to goback and come here again on her company visa.I really cant understand what is that for.
Now the question is
1.Is it safe for her to change to L1again and have visa stamped in India given our situation of GC.If so when.I mean after receipt notices/finger printing etc etc?
2.Any idea of y these companies doesnt employ their own staff who are in EAD.
Any one gone thru any of the above situations.?

Hi,
I currently am on F1 Visa- OPT valid till June 2011.
My employer will file for H1 this April.
If my H1 is rejected for any reason, will I be eligible to work on F1 - OPT visa?

Hi,
I recently received an e-mail from my Lawyers about notification of H-1B Approval Notice (I-797).
My Masters OPT has expired in January 2009. Hence, I enrolled in a degree at a new school to get CPT work permit. My CPT work permit is expiring on 05/09/09.
As my H1-B petition is approved and the change of status has been applied, I came to know that my F-1 status is terminated, when I went to school to get updated I-20, with the new work permit.
What can I do at this moment, to get work permit.
Am I eligible for "Cap-Gap" relief?
Please let me know.

If I understand it right.. The whole House of Reps is up for re-elections every 2 years and 1/3 senate members get reelected at the same interval too...
Does any one know what happens to pending bills at the time of elections..Specifically regarding S2611...If say the conference committee reaches a compromise just before elections but for some reason they dont get to take a vote on it... Does the new senate and house carry the bill forward from that point or does the bill gets reset ?

H-1B employers need to be aware that June 30, 2009 will be the last day that the Department of Labor�s LCA Online system will be operational. As of July 1, 2009, all LCAs for H-1B and E-3 cases will need to be submitted through the iCERT portal (http://icert.doleta.gov/) and that means the end of instant LCA certifications.
This has very important implications for the timing of H-1B and E-3 applications as they relate to new hires and extensions. Employers will need to allow for delays in LCA certifications of at least 7 days rather than the instant certifications that were previously issued.

Hi,
My wife has received the ASC notice of biometric appointment. But I did not. She filed as dependent of my concurrent I-140 + I-485 case. I am wondering if there is anything wrong. Should we receive the notice together? Or it is normal to have seperate appointments? Then how long could be the interval between the notices? Anyone in the same situation before? Could I find it out by Infopass appointment?

C-SPAN, the exclusive video chronicler of Congress, yesterday took a major step to loosen its copyright hold by announcing that it would no longer object to YouTube or bloggers posting its footage from the Hill or from federal agencies online. The content makes up about half the cable channel's programming.
Use of the video footage became awkward recently when Republicans accused Pelosi of "pirating" some clips for her new blog, the Gavel. C-SPAN explained that floor footage is shot by government cameras and that Pelosi was on firm ground using it. But C-SPAN did ask her to take down a clip of a committee hearing shot by a C-SPAN camera.
A C-SPAN spokeswoman said yesterday's action was a nod to the ever-changing technological landscape.

Hello everyone,
I had filed for my I485 on 19th July at Nebraska. My 90 days are getting over on 19th Oct. Still I have not received any receipts for I-485,EAD,I-131.
My lawyer is going to call USCIS to inquire about my case.
Does any one had experience calling USCIS after 90 days were over and the USCIS tracked your application and you got your receipts.
Would be great if any one can share there experiences.

TSC has cleared my EAD in 10 days. Applied on 27th of March 2009 and got 'Card Production Ordered' message on 9th of April 2009

Domicile Certificate i.e. Certificate of nationality shows the date of birth.Can this be used instead of Birth Certificate?
