With my knowledge, I don't think your current salary should matter for the future employement. But it shouldn't be grossly differrent. One of my friend got his GC approved with H1B salary less than salary mentioned in I140. What I would like to say is not worry to about it much until your attorney says it is a problem.

Hello:
I got two EAD extensions in past and applied for the same third time. Earlier, EAD Renewals took only 2 weeks time ( from VSC). But this time it is not the case. It is still pending for 4 weeks now.
Are there any recent EAD renewals from TSC for anyone? Please let me know if anybody has similar case?
PS: Since my case(I-485) was transferred from VSC to TSC, I applied for EAD renewal at TSC this time.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

The Senate voted 59-40 this morning to table Senator Durbin's latest version of the DREAM Act and will instead take up the House version passed last night probably early next week. USCIS used to have a lot of difficulty raising fees and would only get increases approved every few years. They now raise their fees frequently and have just announced their intentions to do so again. In the past, they blamed poor service on the lack of resources and promised - many times - that more money would translate in to better results. I once supported this view. But no longer. I am an American citizen. My Chinese wife of 3 years and I will move to St. Louis and buy a home there. She is a businesswoman and must return to China several times per year to take care of a business there. She will be applying for her immigrant visa very soon.
HOW MANY DAYS PER YEAR CAN SHE LEAVE THE US PER YEAR WITHOUT PUTTING HER IMMIGRANT VISA IN JEOPARDY?
Being a US resident is more important that the job, but we would like to do both, if possible.
I apprecite ANY advice formn knowledgeable people, including non-lawyers.

i applied my wife's H4 visa renewal on Feb 2008 but received the USCIS Ack as April 2008. when i see the processing times now looks like the processing time for the I 539(H4 Renewal) is October 2007
Does any body have any understanding on the processing times on when my H4 Visa petition would be processed with USCIS ack date as april 2008 . any suggestions would be apreciated

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.
We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.
