Guys,
My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.
I just don't want to loose my H1 status in any case.

Hi All,
Just wanted to share this information with everyone so people around the same petition date can be hopeful of getting their 140 approved soon.
My I-140 got approved yesterday through NSC. Petition was filed on 4/1/2008. I am in EB-3 category.

Maybe the 60 Minutes story from a few months ago is making a difference. DHS finally agreed today to show some humanity and not proceed for two year with deporting widows and widowers of US citizens (often American soldiers who die in combat) who only were denied green cards because their spouses died before USCIS could finish processing their cases. The courts have not been consistent in their rulings and it is going to take the US Supreme Court settling the matter (or DHS backing down). Hopefully, this marks the end of USCIS' rabid pursuit of a population that deserves...

I was on F-1 when I applied for I-485 (my wife was the primary applicant). My I-20 expired 6 months back, and I'm working on EAD. I'm planning to travel to India and use my AP for return. Will that be fine ?
What about my I-94 expiry ? I still have a 2 yr old I-94 on my passport, marked F-1/D-S.

No. Wife's status change is independent of husband. H1 status of husband is not invalidated by wife's use of EAD.

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Did everybody who filed Jul 2nd at NSC got their reciepts?
seems like TSC is done entering Jul 2nd application as Jul 3rd-5th are getting their reciepts. It makes me wonder as to how the reciepts are issued if Jul 2nd filers are waiting and farther dates got their reciepts. Is it only issuing delay ?

A RFE is not related to the type of processing (regular / PP) but depends on how well the petition was prepared.

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

11,100 H-1B visas remain of the 65,000 quota with 1500 more claimed over the last week. That's a moderate increase from the roughly 1200 used weekly over the last month. I'm pushing my exhaustion target up a week. The master's cap of 20,000 will be reached sometime this week, almost exactly the date I predicted several months ago. The 400 visas claimed weekly in this category will presumably shift to the general H-1B cap and that could accelerate depletion of those visas. That being the case, we could very well see the cap reached next month.

Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?
