I work for company A which sponsored my L1B (my current visa status). Also, few years back company B sponsored my H1B which for some reason I did not utilize (did not even get it stamped) and hence company B cancelled it. Now my questions are -
1. Can L1-B be transferred to H1-B without going through a new visa application?
2. Can the cancelled H1-B be re-instated and utilized?
3. If another company C applies for my H1-B what are the chances of getting it looking at the current work visa regulations and prospective changes? Will my past petition of H1-B cause some issues with consulate?
4. My wife is on L2 and as EAD. Once I file for change of status will the EAD still be valid or it will automatically be void?
Please Help...

I have to file for I-485 along with EAD and AP, I live in Phoenix and I am applying for 485 based on an approved I-140 based on NIW. Please let me know if I have to file in the Phoenix lockbox or send it to Nebraska.

I have filed an appeal for a rejected I 140, which is I 290B.
I also filed a new I 140 using the same labor (EB3, august 2003)
Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
I am confused now... does this mean they are working on the case?
constant changes like these furstrate me when there is no message or text change in status.
Can the gurus here predict according to similar trends? what can I expect?

Yes, your current & past paystubs(Primary H1B holder) are needed to grant H4 Visa for spouse. H4 is a dependent visa and is granted based on the primary H1B visa holder's status. In case of transfer from H1B to H4, his paystubs are also needed to proove that he was in legal status during this time.

I am seeing people with july 2nd dates getting their checks cashed, and there maybe a quick jump after July 2nd because of the bulletin fiasco we had. And plenty of people have filed after July 17, Could someone tell me if their checks have got cashed? This could be a helpful thread for After 17th filers.

I applied for extension of stay to California Sercice Center. But if I move to Texas, will be my case transfered to VSC??

if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts

I would really appreciate it, if someone could give me some advice.
Here is my situation, in January 2005, I married my girlfriend, who I had dated for little over a year. She is a US born citizen, so we decided to file for my permanent residency upon marriage. Upon receipt of my Green Card in Jan 2008, I filed for naturalization. Our relationship started heading south last year. We tried counseling and it didn't work out. We finally decided to part our ways amicably in Sep, 2009.
I am 34 years old and for reasons unknown to me, I am showing signs of age. I have been also getting some pressure from my family in India to remarry. Though I do not have any plans to marry immediately, I wasn't sure if my getting naturalized in February 2009 would have any impact on marrying someone from India sometime next year?
Please let me know, if there are any cooling off period required?

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

I am currently on H1B visa which will expire next year ie Nov2011. My employer just stated that due to economic conditions, they will not be able to file my GC.
My husbands company has already started his GC process ( his labor n I140 is done)but my name isnt on his application yet. We are waiting for the date to become current n then my name can be added on is 485 application as his dependent. His PD is Aug 08.
Basically I was interested in knowing abt future based employment GC. Has anyone done that before?
Is anyone aware of companies who would be interested in doing it. I just need to buy like max 2-3 years ....just to keep my H1B extensions going. I like my current job so really want to avoid changing it unless there r no other options left basically.
Pls suggest me options that I have to get H1B extension after Nov 2011 and continue working.
Any suggestions are appreciated. Thanks!

Current Status: Notice returned as undeliverable.
On May 14, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.
I have not moved in 2 years and have been receiving notices, EAD cards etc. at this address. I called Uscis and gave them my address again.
Has this happened to anyone before? How long has it taken to resolve the situation. Did you contact your local post office?

Hi,
I got RFE on Advance Parole requesting proof that I have complied with NSEERS.
All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.
Last time I travelled out of US was back in May 2001 for couple of weeks.
Now got this RFE any idea what do I need to submit.

Skin test and X-ray have nothing to do with a USCIS Physician's reputation buth rather on the outcome of the physical exam. However what is important is the amount the Physician is charging for the medical examination. I have an appointment with Dr Alfred in St Louis next week at Forest Park Medical clinic. Appointments are very hard to get by in St Louis.
