I am a US Citizen and will be filing a petition (i 130) to bring my mother over on a greencard.
Recently on her visit to the US on a visitor visa she was marked as NO AOS/COS/EOS on her I - 94
and she left by the date specified on her i - 94.
My question is will it have any effect on her GC petition and what is the current wait time for consular processing on an i-130 petition

Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

Hi,

Before my Perm and 140 were approved we got my H1-b extended till September 2011.
I am planning to visit my home country and need to attend for Visa stamping. I have booked my tickets too.
The problem is my company has recently changed its location and I have the old address on my paperwork (I-797, LCA etc)
But the latest pay stubs have the new Address.
Will I have any problems when I attend for Visa stamping?
Do we need to apply for the ammendment? In that case should I postpone my trip, get the paperwork and then go for stamping?

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

1) Could the change in employment trigger any flags since I am changing companies and this is a future employment GC case (though its almost 3 years since the I-485 was filed)
2) What do you suggest I do since its so close? I waited all this time just not to complicate things (and remain on H1) but then as soon as have to start work on EAD, the date also becomes current (which I am definitely very happy about ) but now since both these events are so close, I am not sure what to do.
3) What other things are there to keep in mind in case of a future employment case?

I have heard it is possible to change employer on 7th year of H1-B, though not immediately. The new employer should file LCA more than 365 days before the H1-B expires. Next time when renewing H1-B it can be renewed with new employer.

I have B1 visa and and right now I am in US on client support.
I want to get into a College for further studies for which I am unaware of the legal formalities to be completed.
I already have a letter of internship with a US company and the college is giving me a letter for change of status i-20.
As far as the immigration goes for change of status of visa, it says that I need to go out of the country and then come back, with stamped as 'intent to study'. So is it really required?
However still it is confusing for me as to what other formalities are to be completed regarding the same.

My I-140 was processed at the Nebraska center, but my attorney sent the I-485 case to Texas Service center. Since my I-140 was filed at Nebraska, I was expecting my I-485 would be sent Nebraska also.
Should it be sent to Texas center or Nebraska?

Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

Does anyone have the latest on labor substitution? I am being offered a pre-approved labor. I will have to switch to a not so good employer for the same. I want to know if there are known rumors at this moment about cancellation of pre-approved labor.

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. The inventory number does not include the EB1 and EB2ROW filings, which are always C and out of queue/approved in less than 6 months. They are not shown in inventory numbers.

presently i am working on h1b for a tech company. I also have my ead (obtained as a result of july 07 fiasco).
Can i start a company, incorporate a llc or a class c company on my ead? What would be my options?
i know that if i had solely my h1b, i could start a class c company but not work for it(use a gc or a citizen) to do it
my question is that can i still continue on my status quo--ie use h1 for my employer and use ead to start a company, or i have to give up my h1 status? since my wife is on h4, i have to continue on h1b until she gets her ead.
