Folks,
Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.
When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?
I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?
i am quite sure you can...infact you can do this at any stage including after filing I-485.
please verify with an attorney...you will need one to do it correctly.

I applied for my EAD and AP extension on AUG 17 2009 and my EAD was expiring on AUG 29th 2009. While my wifes EAD and AP got approved, I had an RFE as I had not sent the recent photographs so I sent that and the receipt date for that was OCT 9 2009.
I continued working and got paid, after speaking to friends I realized, getting paid on a Expired EAD is not right.
I have taken a infopass to discuss this with USCIS to get an update.
One more point I wanted to make was that my payroll company doesn't know about this and doesn't care. But if I bring it up then .they might immediately terminate my employment.
How do I fix this? Please suggest.

I am initiating this poll to find out priority date segments, as I could not found a poll for priority dates tracking.
I have divided priority dates in eights segments. From the eight segments, I have created three specific segments from Jan 2004 to June 2004, June 2004 to Dec 2004 and Jan 2005 to March 2005. The people in these segments are most likely to get their GC (If USCIS process in FIFO manner) as soon as the backlog with priority dates before 2003 is cleared. The first three months of 2005, Jan to March, when lots of people applied, just before a new PERM labor certification process was introduce. This will help separate the three months from the rest of the year 2005.
Please join me to track priority dates which is the key date for GC approval.
