It is a letter by your I-485 attorney to USCIS mentioning your pending I-485 application (receipt numbers, filed where, including everyone part of the application), about your company securing I-140 approval under EB2 category for you and requesting to interfile this I-140 with pending I-485 and approval based on case is being current now (mentioning priority date). Copy of the I-140 approval notice (EB2) should be attached.
Some attorneys do attach I-485 receipt copies too. Also, your attorney may ask you to sign on the G-28 form that he/she is representing your case.

I would suggest to meet your local Senator and pursue your case. Age-out is the genuine problem and I believe no lawmaker will deny to help in age-out case for legals. Only thing you need to pursue them how monster of retrogression is killing kids of legals with age-out weapon!

None of the bills being considered currently benefit children of would-be legal immigrants, while the children of illegal immigrants are protected by the proposed DREAM ACT. Please write to senators and house representatives highlighting the "age-out" problem.

I agree 100% too. Just feel so helpless.
After reading all your comments, I reached to a conclusion
We all are being fooled and frusturated by USCIS.
Now the question is, what are we going to do about it, keep complaining and whinning about it, or do something constructive.
Well I believe when we are all so knowledgabel about USCIS efficiency, what do we do next?
Well lets give out a big shout to something big, get some media attention and put pressure on USCIS. Unless we still choose to visit IV to express our frusturations and then logg of this webiste and continue to our daily cores.

It's call reseach topic.. We have to find some USCIS support documents for each case. We need some earlier USCIS decisions for each senarios/theories.
RG provided few supporting CIS rules in earlier post and seems logical. But not sure if RG or RK is right.

It seems that according to RG, EAD will remain valid till the time to file appeal (MTR), once appeal is filed the applicant would be able to work. He also suggested to go on EAD to save any time remaining from initial 6 years.
According to RK, EAD will be invalidated, person is to be deported as soon as CIS denies 485 in error. He strongly suggest NOT TO GO on EAD if some one has H1 as an option.
According to Chandu's blog, RK seems to be correct; but then RG is also a very reputed and experienced immigration lawyer.
What is correct? Both are 180 degree opposite to each other? Any one?

Let us wait for the statement from USCIS
It is a long wait.
First the DOS publishes a preliminary report on March/April
then the final report from CIS is not published until July/August of the following year.

The first bulletin with Eb1 and Eb2 spill over.
Last year:
Mar 2008- India Eb2 U
Apr 2008- India-Eb2 01 Dec 03
This year may be:
Mar 2009- India Eb2 15 Feb 04
Apr 2009- India Eb2 28 Feb 05 (My PD :))
As per March 2009 visa bulletin EB2-China is already 15 Feb 05.
If USCIS repeats last year's pattern of spill over from April then both EB2 China and India move together.
As they move China's dates they need to move India's dates(both share the spill over as retrogressed countries).
Keep guessing on EB2-China's forward movement and most likely would be the same for EB2-India :)

Correct me if I am wrong, ---but I thought that "This Ammendment" was attached to a defence bill. I dont think that it was the ammendment that was shot down, but the whole defence beill.

Once the window is open. They pre/adjudicate as per the Reciept Date. Also if all backgrounds checks are over...then among other attributes it falls within the "low hanging fruit" area for quick pre/adjudication.
See the Standard Operating Procedures link posted above for a clue. Also recently the NSC confirmed this. Will post the link as soon as I find it.

I don't think it's possible, or people will all file to Chicago. There is one thing you can do though, which is to write to Atlanta center and express your concerns. Probably also write to the higher officials to the Department of Labor. I believe the more people write to them, the more chances they will look at it seriously.

IV Core,
What is IV's position on ammendents for people who have filed PERM only and have not filed I-140 yet.
There shall be an ammendement which allows these people to keep using old system(EB) to get their green card.
It is totally un-fair to null and void their application and get them into new point based systems and force them to face long delays.
Please let us know.

For committed people like you, we can request IV core for some special consideration.
But I support this initiative. Just see the FOIA thread. We could not even pool up 5K and there are at least 5000 members out of which at least 500 active users.
Unless there is some intiative like this, it will be impossible for pushing any lobbying activities. There are many people who wants every thing free.

With US becoming in-tolerant to Legal immigration, Australia moving to toughen rules, BNP winning seats in UK, Singapore curtailing immigration, India denying visas and the list continues..
It is clearly the order of the day.. We human beings forgot that it is basic human right to immigrate as recognized by UN. We are on verge of becoming herding animals if not more restricted.
I hope things change. But I think it is going to change by the time most people don't care anymore about immigrating.
I have seen/heard of Indian elite university students declining US offers just to avoid immigration headaches.. My close friends back in India are kind of joking about those waiting in the line just to get the papers filed to move to any other country than India.
This year H1B quota is an eye opener. I think the trend continues next year and year after.
But most of the times, all governments realize about the ground reality only in the end when the damage is made, not when it started.
Such thing can never happen. Also, don't lose hope. Look at how the world was before. Slavery, racism, castiesm, untouchability, intolerance, poverty etc.... it has always been a struggle to navigate through all these barriers and we are still navigating.
Basically the attitude is "when my house is burning why should I accomodate these people" - it is how the world is and we have to navigate.

No. It is true to some extent that we are paying more taxes.
Take my case for an example. My kid is not an American citizen. She moved with us when she was a baby and currently under H-4 status. So she could not obtain social security number that is good for "authorized to work". Without the SSN, we were not eligible for certain child tax credit, which was hundreds of dollars. I tried an ITIN but I got a formal response from IRS that the child still needs to have a SSN to be eligible for the credit.
If you ever filed your tax return yourself and have a kid, you will know what I mean.

Point is, let us stop playing permutation politics and focus on what matters most... but I guess it is hard to ask folks to forget their inborn / bred selfish nature and myopic world views...

I think the longest wait I have ever seen is of my friend who entered the US in 1992. He did his Bachelors, then did some work on OPT, then did his Masters, then did some work on OPT, then tried to do PhD but couldnt finish it in , got a fulltime offer, worked on H1 then on extensions and finally got laid off in 2008 before his 485 could be filed. He had enough of it and finally said goodbye to US and left :) So that's 16yrs!

Sometimes it still bothers me but I guess I need to get out of this critics and appreciations and want to concentrate 100% on agenda: Fight against injustice in AC21 implementation.
