There is no official process or filing fee. Attorneys generally represent both the employer and the employee. Because revoking the petition could harm the employee, a conflict of interest arises. Accordingly, most immigration attorneys would not want to be involved in assisting in the revocation of petitions.
Do you mean to say, the employer just sends a letter with a signature and LIN numbers to revoke and USCIS revokes them?
In that case does USCIS send a confirmation of revocation of all the requested LIN numbers to be revoked? Or it is just a one-sided handshake?

If somebody is eligible to jump from Eb3 -> EB2, then he should be allowed to jump.
I am EB2. I had to change my job as my previous employer didnot allow me to file in EB2 as I didnot have prior experience even though i have MS from USA.
I changed my job and now I am in EB2. My PD is Feb 2008. Sucks that I missed the bus in July 2007.
Nobody should go through what I went through. If somebody is eligible to jump, then he should jump from EB3->EB2.
Considering the current delays in labour and I140 approvals, I think the entire process of filing for new labor, then I140 and the PD porting will take around 2yrs if there are no Queries. :p
Unless somebody's PD is mid 2006 or 2007 above in EB3, I dont think this EB3->EB2 jump will be helpful. :rolleyes:

What the USCIS has done today is what they call "Locking the stables AFTER the horse has bolted" ;)
What a bunch of idiots, i swear this is WORSE than ANY of our home countries. Like I told my friend yesterday, atleast if the USCIS call center was based in India, the answers would have been consistent. They may have all been Wrong, but atleast they would be consistent.
This is going to drag forever. Now, the USCIS will surely get investigated, as they approved some applications without FBI check complete....bunch of idiots in fact. I wonder when Chertoff will resign.....

It is good to know someone with PD Aug 2004 in EB3 from India is getting approval. This gives me confidence that there are not many people waiting in line when the doors open in Oct 2007 with new quota.:)
PD for EB3 India in the June Visa Bulletin was 1st June 2003, meaning all those whose Priority Date on the LC on or before 01st June 2003 are eligible to apply for the next 2 stages.
If so, how could someone with a PD of Aug 2004 in EB3 India apply? Perhaps I am missing something.

pardon my ignorance. But since you already applied for 485, it means you will get GC in april 2009(if pd becomes dec 2005) ?
Yes and No. If the PD stays at (let's say) December 15, 2005 and during that time the officer is able to review my file and request a visa number from the DOS then I will get the green card BUT if during this process the PD moves back (let's say December 14, 2005) then I will have to wait for it to be current again for me (i.e. December 15, 2005).

If the inflation does not improve, it may continue until 2014.
Next year in india we can expect home credit crisis ( like USA). - more chances with this current economy.
The current prices in Hyd ,Blore, Chennai are artifical booms. - it will come for a correction.
But for sure, if you buy a property you CANNOTexpect that to go up by 500 or 700 % up in a year.
But real estate is always a good investment in life.

How come observations made over years on 100's to 1000's of students are "unsubstantiated"? Of course you may want not to believe me; that is your prerogative, and so is writing my own experience mine.

You started in 100s & are now talking about thousands and I am sure if this argument continues you would go to even higher numbers just for the heck of proving your point. After all, its a matter of pressing few keys on your keyboard....but what credibility does it has when there is no way to validate??
May be, as "NKR" pointed out, you have some bad impression about the Univs in certain region of India - looking at the list you provided!! Otherwise - Anna university is considered to be a top rated institute in south india esp., TN state. Osmania is also a very decent one (esp in Engg/comp sc). Both these universities are very famous for their ability to attract a lot of recruiters (All top indian companies + many MNCs as well). And here on this board, you just rule those out with a single word - Crappy!!

I think the longest wait I have ever seen is of my friend who entered the US in 1992. He did his Bachelors, then did some work on OPT, then did his Masters, then did some work on OPT, then tried to do PhD but couldnt finish it in , got a fulltime offer, worked on H1 then on extensions and finally got laid off in 2008 before his 485 could be filed. He had enough of it and finally said goodbye to US and left :) So that's 16yrs!

Hi ind_game, attorney and all readers,
After reading ind_game last quote "God save AC21.....". I have following questions:
1. Do you know any one (your friend, client) used AC21 and faced same problem? Es
2. Is it true that AC-21 info don't get updated in the USCIS records?
3. If yes (2 question), then x-employer I-140 revocation will ALWAYS result in THIS kind of problems (as ind-game is facing)?
4. To attorneys only: Is AC-21 really helpful or misleading? Asking because if it don't update in USCIS records.

There is no case of AC21 being denied. It is the law, no need to be scared if you did everything right.
